Terms of Service

  1. Tutoring content and approach: The approach to tutoring (e.g., math subject matter to be covered, structure of sessions, evaluation, additional content) will be discussed and agreed upon at the beginning of your engagement with Elementis Learning. In addition, we will work together to establish explicit goals. Content and approach will be refined as necessary, based on what’s most effective for your child.

  2. Supplemental material(s): Elementis Learning may use third-party online tools or content to complement tutoring sessions. In some cases, this may require the student to create an account with these third-party services (e.g., Beast Academy and Art of Problem Solving). Elementis Learning will inform parents in advance about any such supplemental content or services, and they may opt out of using these services upon request.

  3. Schedule and Duration: Tutoring sessions are in-person or via Zoom and 60 minutes in duration, unless otherwise agreed upon. Sessions can be scheduled using either the Elementis Learning online scheduling tool (http://elementis.info/schedule) or by verbal agreement.

  4. Location: In-person sessions will be performed at our physical offices. In-home tutoring is possible on a case-by-case basis, and is subject to a surcharge of $50 per session, unless negotiated otherwise.

  5. Payment: Fees are specified in Services or made by verbal negotiations. Prices are subject to change over time. Fees are payable via ACH, credit card, PayPal or Venmo (@elementis-learning). Invoices are issued once a month at the end of the month, and cover the sessions delivered during the course of that month. All payments are non-refundable. Payments are due within 30 days of the date the invoice is issued. Failure to pay within 30 days from the date the invoice is issued will result in a late fee of $50. Accounts with invoices left unpaid more than 60 days after issuance will be subject to termination, with full payment due at that time.

  6. Cancellation and Rescheduling: If either party needs to cancel or reschedule a tutoring session, 24 hours advance notice is required. No-shows and cancellations within the 24-hour window will be charged for the session.

  7. Privacy and confidentiality: All terms related to privacy and confidentiality are specified in the Elementis Learning Privacy Policy, provided as a separate document and at http://elementis.info/privacy-policy.

  8. Responsibilities and outcomes: The tutor will make every reasonable effort to support the student's academic growth, but they cannot guarantee specific results (e.g., homework or test scores, grades, teacher evaluations, executive functioning abilities).

  9. Emergency Medical Treatment: In case of a medical emergency during tutoring sessions, I authorize the tutor to seek medical attention for my child if neither I, nor any other appointed guardian for my child, can be reached by telephone or SMS message.

  10. Liability: Elementis Learning and the tutor are not liable for any injuries, accidents, or damages that may occur during the tutoring sessions.

  11. Termination: Either party can terminate this tutoring arrangement with one week’s notice. An invoice will be issued upon termination for any sessions not previously invoiced, with payment terms Net 30 days from the date the final invoice is issued.
